Planning inquiry now cancelled following withdrawal of application LINKS

Dear All 

We have just been advised by Mr Brooker that a date has been set for the Public Inquiry. It is Tuesday 25 October 2005 and the hearing is expected to last 4 days.

 

First, we wish to object in the strongest terms that we were denied the opportunity to comment upon the date set, despite RAID being a party to the Inquiry. We received no notification of the date set from the Inspectorate, nor any opportunity to comment upon its suitability by the date for doing so of 31 December 2004.

 

We regard this as unacceptable and a breach of the Rules. We request urgent comments from Debbie Smith.

 

Nevertheless, we advise that we can be available for this date, and intend to be so. But I notify you now that I am departing on an overseas business trip on Sunday 6 November 2005. We therefore request that the Inquiry sticks to its four day time slot and does not over-run.

 

Furthermore, and as discussed today with Mr Brooker, we request that a pre-trial conference is held between the parties with the aim of establishing common facts, establishing admissible evidence, and establishing who will make what points at the Inquiry.

 

We trust that Ms Smith will consult well in advance with all the parties as to a suitable date.
